Settlement of overdue debts and the protected category of persons
- a reason for working with the Debtor – an Overdue debt;
- violation of the term for the fulfillment of obligations by the Borrower, starting from the day following the date of payment of the obligatory monthly payment under the Loan Agreement.
To ensure the timely repayment of credit debt, preventive work is carried out with the Borrower, within the framework of the strategy of work FIU. As a result, the Borrower is automatically sent an SMS message with information about the date of payment and the amount of payment on the loan within the established time frame.
The following means can be used to interact with the Debtor when working on the settlement of the Overdue debt:
- direct interaction (telephone and video conversations, personal meetings);
- sending postal items;
- sending text, voice, and other messages using telecommunications.
- The decision on the expediency of carrying out the operation Assignment of the Right of Claim is agreed by the Bank's Collegial Body.
- Upon the adoption of a decision by the Bank's Collegial Body on the Assignment of the Right to Claim the Overdue debt, actions are taken in accordance with the Bank's internal procedures.
- Within 10 working days from the date of the Assignment of the right of claim under the loan agreement to the new creditor, the Bank is obliged to inform the Debtor in the manner specified in clause 2.2.1. Of the document and/or provided for by the loan agreement, about such a fact and the transfer of the Debtor's personal data, as well as provide information about the new creditor (name, identification code of a legal entity in the Unified State Register of Enterprises and Organizations of Ukraine, location, information for communication – phone number, address, e-mail address).
The Assignment of Rights of Claim may be applied to the Loan agreements of the Debtors, under which work was carried out to settle the Overdue debt in accordance with the Bank's Strategy for Collection by:
- direct interaction (telephone and video conversations, personal meetings);
- sending postal items;
- sending text, voice, and other messages using telecommunications.
The procedure for repayment of the Overdue debt is determined in accordance with the legislation of Ukraine. In the event that the Debtor makes payment of the Overdue debt to fulfill obligations under the Loan Agreement, this amount shall repay the creditor's claims in the sequence provided for by the Loan Agreement.
When settling the Overdue debt, the debtor can independently choose any convenient way to repay the Overdue debt:
- by making a payment using the cash department of the Bank;
- by making a payment using the terminal;
- by transferring funds using Internet banking;
- any other way to transfer funds.
When settling the Overdue debt, the Debtor must notify the Bank that his authorized representative is representing his interests in settling the Overdue debt by contacting the Bank's branch with properly executed supporting documents that confirm the identity and the right to represent the Debtor's interests to the authorized representative.
According to amendments to the Law of Ukraine "On Consumer Lending", which supplement the requirements for the settlement of overdue debts with a protected category of customers.
During the period of martial law in Ukraine and within 90 days from the date of its termination or cancellation, the lender, and collection companies engaged by the lender on a contractual basis to directly interact with the consumer, his relatives, representative, heir, guarantor or property guarantor, third parties, are required to comply with additional requirements regarding ethical behavior for a protected category of customers.
The protected category of customers includes:
- military personnel of the Armed Forces of Ukraine, other military units formed in accordance with the laws of Ukraine, and law enforcement agencies for particular purposes, the State Special Transport Service, the State Service for Special Communications and Information Protection of Ukraine, performing military service on the territory of Ukraine;
- military personnel who become disabled as a result of an illness associated with military service or as a result of disease after their dismissal from military service related to military service;
- family members of military personnel who were killed, deceased or missing;
- persons in captivity, persons with whom communication is lost, persons missing.
Confirming documents that a consumer belongs to a protected category are:
- for military personnel of the Armed Forces of Ukraine, other military formations and special law enforcement agencies formed in accordance with the laws of Ukraine, the State Special Transport Service, the State Service for Special Communications and Information Protection of Ukraine, performing military service on the territory of Ukraine – signed by the commander (chief, head ) or a person replacing him, of the relevant structural unit in which such a serviceman is serving, or the director of the territorial center for recruitment and social support, who took measures to recruit the consumer for military service, a certificate affixed with the official seal in the form established by Appendix No.2 to the Law of Ukraine "On Consumer Lending";
- for military personnel who become persons with disabilities as a result of an illness associated with military service or as a result of disease after their dismissal from military service related to military service – a certificate of a disabled war veteran;
- for family members of military personnel who were killed or deceased – a certificate of a family member of the deceased;
- for persons in captivity, persons with whom contact has been lost, persons missing, and family members of missing military personnel – the information provided by a state-owned enterprise acting as the National Information Bureau that the person is being held captive or is held hostage by the aggressor state, or is included in the register as such, with which communication is lost, or is missing.
Loss of belonging to a protected category of persons
The customer must inform the Bank about the loss of belonging to a protected category of persons within 30 calendar days.
The consumer can personally inform about belonging to a protected category, as well as his relatives, representatives, heirs, guarantors, or property guarantors, using the contact details specified in the list of contact details of the Bank.
The list of contact details of the Bank, which are used to receive applications from consumers of financial services regarding the activities of the attracted collection company (in the case of involving a collection company in settlement of the Overdue debt) and the provision of documents confirming belonging to a protected category of persons:
